Rules for Park and Boat Landing

A. Purpose

To clearly define rules governing the use of the Community Recreational Area of Mysterious Waters, an unincorporated subdivision of Wakulla County.

B. Authority

Articles of Incorporation dated September 6, 1975, and Bylaws (as modified in 1979) for the Mysterious Waters Property Owners Association.

C. General Information

The Community Recreational Area is intended for use primarily by Members of the Mysterious Waters Property Owners Association, Inc. (MWPOA). It is understood this will include Property Ownership and Guests; however, every effort must be made to ensure that the rights and privileges of all property owners are protected and not infringed upon by an excessive/unexpected number of guests or uninvited visitors.

Furthermore, the Mysterious Waters community intends to maintain a peaceful and relaxed environment conducive to family style activities for all ages. As unavoidable growth places ever increasing demands upon the community Recreation Area, it becomes imperative that clear and realistic rules be adopted to protect our investments and the environment, and to prevent any disagreements caused by vague or undefined rules governing use of the Community Recreational Area.

D. Definitions

"Community Recreation Area"- that parcel of land owned by MWPOA and bordered by Wakulla River on the east and lying at the end of Mysterious Waters Road. The term "Community Recreation Area." hereinafter referred to as the "Park," is inclusive of all facilities within the boundaries of said area, such as the boat ramp, floating dock, and all buildings.

"Member"- A person whose name appears on the recorded deed of property contained within the boundaries of Mysterious Waters subdivision and their immediate family members. Immediate family is limited to a spouse, children under the age of 18, or other family members occupying the same household. Members, as defined above, are entitled to full rights and privileges as provided for in these provisions. The term "Member," as used in this document, is not to be confused with and is not equivalent to an "Association member," as defined in the Bylaws.

"Lessee"- A tenant on property which is located within the Mysterious Waters subdivision and their immediate family members. Immediate family is limited to a spouse, children under the age of 18, or other family members occupying the same household. Lessees, as defined above, are entitled to full rights and privileges as provided for in these provisions except as stated in General Provisions.

"Guests"- Anyone not meeting the criteria defined for a Member or Lessee.

"Vessel"- Any floating structure exceed two feet in width and five feet in length.

"Mooring"- The act of securing or attaching any floating vessel.

"Special Event"- Any gathering (i.e. party, reunion, dinner, etc.) on park ground which will exceed one hour in length and include more than ten persons, or have an estimated crowd size (including Members) of more than 25 persons, or a situation requiring the exclusive use of the pavilion.

E. General Provisions

Use of Park by Guests

1. Guests must be accompanied by a Member when utilizing the park, unless a Guest is visiting with a Member and is able to confirm Guest status on a visit-by-visit basis.

2. No unlimited use of the park can be granted to any Guest or visitor by any Member or lessee.

 

3. Guest shall be advised by the inviting Member that abusive or belligerent actions, obscene language, or any actions considered offensive to family style activities will not be tolerated.

Vehicular Access to the Park

1. No vehicle access or traffic shall be allowed on park grounds north of an imaginary east-west line coinciding with the north end of the pavilion. This includes all-terrain vehicles, go-carts, and other similar motorized vehicles. This does not preclude use of bicycles.

2. Vehicles or trailers shall not be left at the park unless facilities are being utilized.

3. No vehicle to trailer shall be left unattended or parked in a manner such that access to the boat ramp or floating dock is hindered.

Use of Floating Dock (as revised March 28, 2004)

1. No permanent mooring of vessels is allowed. Permanent mooring is defined as a period of time exceeding three consecutive days. This restriction shall become effective on October 25, 2020. A minimum of one-day removal is required if a boat has been moored at the dock for two to three days. Dock use is on a first-come, first-served basis. The floating dock is intended for boats being used, not for storage.​

Offenders will receive a certified letter from the Association stating that their boat is in violation, asking that the rules be honored. Included in the letter will be a notice that if these rules are not honored, the Association will revoke the owner's right to use the dock until the next Homeowner's Association meeting, when a vote will be taken regarding the restoration of dock use privileges.

 

2. Vessels will be moored to cleats and not attached to metal stabilizing posts.

3. No vessel may be moored to the dock within the area designated for swimmers, except for the use of launch and recovery.

4. All vessels shall be moored to the floating dock and not left unattended in such a way as to hinder use of the boat ramp or swimming areas.

5. A standing dock committee will be named to monitor the use of the dock and make future recommendations as needed.

Special Events

​1. A special event must be approved in advance by the President or Trustee of the MWPOA.

2. Approval must be obtained at least 14 days prior to the actual occurrence.

3. Announcement of the event must be conspicuously displayed on the bulletin board (located at the entrance to the community) and at the pavilion (located inside the park) for a period of time not less than 10 consecutive days before the actual occurrence.

4. Sufficient sanitary facilities must be provided.

5. All trash and debris shall be removed and the park restored to acceptable conditions prior to noon of the following day.

6. Excessively loud music, obscene language, drunkenness, or illegal/illicit activities will not be tolerated.

7. A request to hold a special event can be made only by a Property Owner, and the Association President or Trustee shall be furnished, in writing, the following information before approval is granted:

     a. Estimated crowd size

     b. General overview of planned activities (party, picnic, etc.)

     c. Date of event and specific start and end time

8. The sponsor of any Special Event is responsible for all damages or costs incurred as a result of said Special Event.

General Rules for Use of the Park

1. Canoe storage racks shall be used only by Members

2. Young children shall be supervised

3. No overnight camping

4. No animals on dock or in areas designated for swimmers if swimmers are present.

F. Exceptions

Exceptions to the General Provisions can be granted only by obtaining a two-thirds majority vote of the Board of Directors.
